TokenPocket Service Agreement

Dear User:

Thank you for choosing TokenPocket services. The TokenPocket Service Agreement (hereinafter referred to as "this Agreement") is entered into by and between TP Global Ltd. (hereinafter referred to as "the Company" or "we") and the user (hereinafter referred to as "you" or "the user"). This Agreement constitutes a legally binding contract between you and the Company. The Company specifically reminds you to carefully read this Agreement and the related agreements mentioned herein before using TokenPocket (hereinafter referred to as "TokenPocket" or "the Software"). TokenPocket is available for download on multiple mobile application platforms, including but not limited to Google Play, Chrome Web Store, and Apple App Store. Please pay particular attention to the clauses highlighted in bold, such as the "Disclaimers and Limitations of Liability", to ensure you fully understand each provision and independently assess the associated risks.

1. Confirmation and Acceptance of This Agreement

  1. You acknowledge that this Agreement and any related agreements apply to TokenPocket and the decentralized applications (DApps) developed and owned by the Company on TokenPocket (excluding DApps developed by third parties).
  2. By downloading the TokenPocket software and creating or importing a wallet, you are deemed to have fully read and accepted all the terms of this Agreement. This Agreement takes effect immediately and is binding on both parties.
  3. The Company reserves the right to update this Agreement at any time. Any revised Agreement will take effect immediately upon publication on TokenPocket, without additional notice. If you do not accept the updated terms, you must discontinue use of TokenPocket immediately. Continued use of TokenPocket will be considered acceptance of the revised Agreement.
  4. If you are under 18 years of age, or if you lack legal capacity or have limited legal capacity, you must use TokenPocket under the guidance of a parent or legal guardian.

2. Definitions

  1. TokenPocket: Refers to the blockchain wallet developed by the Company, based on blockchain systems such as Bitcoin, Ethereum, BNB Chain, Optimism, Arbitrum, Base, TRON, Solana, Ton, Aptos, SUI, EOS, COSMOS, and other blockchain systems to be supported in the future. It includes auxiliary tools developed to facilitate users’ use of blockchain systems.
  2. User: To qualify for using TokenPocket, you must meet the following criteria:
    1. You must be at least eighteen (18) years old and have the legal capacity to enter into this Agreement.
    2. You must not be a resident of any jurisdiction under trade embargoes, UN Security Council resolutions (“UNSCR”), or financial sanctions regimes by the UK Treasury.
    3. You must not currently be subject to economic sanctions, such as those listed under the UN Security Council Sanctions List, OFAC’s Specially Designated Nationals List, the U.S. Department of Commerce’s Denied Persons or Entity List, or other relevant sanction lists.
    4. If you are using our services on behalf of a legal entity, you further represent and warrant that the legal entity is duly organized and validly existing under the applicable laws of its jurisdiction and that you are duly authorized to act on its behalf.
    5. You may only use our services if such use is permitted under the laws of your jurisdiction. If you are located in a jurisdiction where the use of our services is unlawful, you may not use the services.
    6. Ensure compliance with all applicable laws, regulations, and rules.
    7. You agree to use only lawfully obtained and owned funds in connection with our services.
  3. By using TokenPocket, you represent and warrant that you meet all the eligibility requirements outlined in this Agreement. The Company reserves the right to deny access to certain users or amend eligibility criteria at any time.
  4. Usage Terms:
    1. Creating or Importing a Wallet: Refers to the process of using TokenPocket to agree to this Agreement and create or import a wallet.
    2. Wallet Password: Refers to the password entered during wallet creation in TokenPocket. It is used to encrypt and protect the private key. As a decentralized application, TokenPocket does not store wallet passwords on your device or on Company servers. If you lose your password, you must use your private key or mnemonic phrase to reset it.
    3. Specific Users: Refers to users required by the laws and regulations of the Cayman Islands to disclose personal information to the Company.
    4. Private Key: A 256-bit random character sequence, serving as the core for controlling and using digital tokens.
    5. Public Key: Derived unidirectionally from the private key using cryptographic principles, used to generate blockchain wallet addresses (public receiving addresses).
    6. Mnemonic Phrase: A sequence of 12 (or 15/18/21/24) ordered words generated by a random algorithm, compliant with the blockchain BIP39 standard. It serves as a recordable form of the private key for convenient backup and storage.
    7. Keystore: An encrypted file containing the private key or mnemonic phrase, secured by your wallet password. It is stored only on your device and is not synced to the Company’s servers.
    8. Digital Tokens: Refers to the types of tokens currently supported by TokenPocket, including but not limited to BTC, ETH, BNB, SOL, etc.
    9. Materials: Refers to content such as news updates displayed on TokenPocket. These materials are owned by the Company and may not be reproduced without authorization.
    10. Personal Information: Refers to any information recorded electronically or otherwise that can identify a user, either independently or when combined with other data, including but not limited to a natural person’s name, date of birth, ID number, biometric information, address, phone number, bank account details, email address, wallet address, mobile device information, operational records, transaction history, etc. It does not include wallet passwords, private keys, mnemonic phrases, or Keystore. The Company will collect personal information only with the user’s consent and will strictly maintain confidentiality unless otherwise required by law or agreed upon by the user.
    11. Third-Party Services: Refers to products and services provided by third-party DApps, DeFi platforms, smart contracts, open-source protocols, web pages, hardware wallets, online web wallets, exchanges, and other third-party providers.

3. Scope of Services

  1. Create or Import Wallets: For digital tokens supported by TokenPocket, you may use TokenPocket to generate a new wallet or import a compatible wallet created by other blockchain tools.
  2. Transfer and Receipt: You can manage digital tokens using TokenPocket’s transfer and receipt functionalities, which involve using your private key to perform electronic signatures and modifying the ledger on the relevant blockchain. Transfers occur when the sender utilizes the recipient's blockchain address, and the actual transfer and receipt operations take place on the relevant blockchain system (not within TokenPocket).
  3. Market View: You can view exchange rates for supported digital tokens on TokenPocket. TokenPocket fetches relevant exchange rate information and displays it in the "Market" section.
  4. Digital Asset Management: You can add, store, and remove digital tokens supported by TokenPocket.
  5. Browse DApps: Through links provided within TokenPocket, users can access DApps (including Company-owned and third-party DApps) and utilize the services offered by these DApps.
  6. Transaction Records: TokenPocket copies your full or partial transaction records via the blockchain system. However, the transaction records maintained on the blockchain system shall be regarded as the authoritative source.
  7. Service Suspension: Due to the "irreversible" nature of blockchain transactions, TokenPocket cannot suspend or revoke transfer operations. However, under certain circumstances, the Company reserves the right to suspend or limit specific user operations within TokenPocket.
  8. Token Swapping: Users may engage with third-party smart contracts or decentralized exchanges (DEXs) for token swaps. TokenPocket serves as an interface tool to facilitate interactions between users and third parties and displays the results of such token swaps.
  9. Third-Party Content and Services:
    1. Certain services can be accessed through approved third-party providers. This may require creating separate accounts with both TokenPocket and the relevant third-party providers.
    2. You may access or utilize third-party information, products, or services ("Third-Party Content" and "Third-Party Services").
    3. Your use of Third-Party Content and Services is discretionary and subject to this Agreement. However, it may also be governed by separate terms and conditions imposed by the respective third-party providers, which could include fees, disclaimers, or risk warnings.
    4. It is your responsibility to understand the terms and conditions of these third-party services, including how your information is handled under their privacy policies.
    5. TokenPocket does not verify, control, or endorse Third-Party Content or Services and assumes no liability for losses arising from their use. Access to such content and services is at your own risk. TokenPocket disclaims responsibility for any misleading, incomplete, offensive, or otherwise objectionable third-party content.
  10. Staking Services: When accessing staking services, third parties may stake your digital assets on your behalf, acting as validators on applicable blockchain networks. Rewards may be granted for successfully validating transaction blocks. You acknowledge that TokenPocket is not responsible for any issues arising from the use of staking services.
  11. Airdrops: Participation in airdrops is at the sole risk of participants. By participating, you acknowledge and agree to the following:
    1. You represent and warrant that all information provided during the airdrop process is true, accurate, and complete. TokenPocket reserves the right to request additional information and share it with affiliated third-party service providers as deemed appropriate. TokenPocket assumes no liability for losses, delays, or costs resulting from incomplete or inaccurate information.
    2. You represent and warrant that applicable laws do not prohibit you from participating in airdrops or receiving tokens. Using VPNs or similar tools to bypass geographic or other restrictions is prohibited and may result in disqualification.
    3. You are solely responsible for any tax obligations arising from your participation in airdrops and should consult a tax advisor if necessary.
    4. Eligibility to receive airdrop tokens or participate in airdrops is determined at TokenPocket’s discretion or as specified in relevant announcements. Participants must follow all instructions outlined in the announcements or provided by TokenPocket.
    5. All risks associated with airdrops are borne solely by the participants, who are fully responsible for any activities or outcomes related to their participation.
  12. Other Services: TokenPocket may provide additional services deemed necessary by the Company.

4. Common Issues Users Should Be Aware of When Accepting Services Provided by the Company

  1. In alignment with the decentralized nature of blockchain and to protect the security of users' digital tokens, the Company provides decentralized services that differ significantly from those offered by banking and financial institutions. Users acknowledge that the Company (operating under a decentralized model) does not provide the following services:
    1. Storing users' wallet passwords (i.e., the passwords set when creating/importing wallets), private keys, mnemonic phrases, or Keystores.
    2. Recovering users' wallet passwords, private keys, mnemonic phrases, or Keystores.
    3. Freezing wallets.
    4. Reporting wallets as lost.
    5. Restoring wallets.
    6. Reversing transactions.
  2. As the Company does not provide the services listed above, users are responsible for safeguarding their devices containing TokenPocket, as well as backing up TokenPocket, wallet passwords, mnemonic phrases, private keys, and Keystores. In the event that a user:
    1. Loses their device,
    2. Deletes TokenPocket without backup,
    3. Deletes a wallet without backup,
    4. Has their wallet stolen, or
    5. Forgets their wallet password, private key, mnemonic phrase, or Keystore,
      the Company cannot restore the wallet or retrieve these credentials. Similarly, if a user makes an operational error during a transaction (e.g., entering the wrong transfer address), the Company cannot cancel the transaction.
  3. The digital token management services provided by the Company and TokenPocket do not encompass all existing digital tokens. Users should refrain from operating unsupported tokens via TokenPocket.
  4. TokenPocket serves solely as a management tool for digital tokens and is not a trading platform or exchange. While the Agreement may reference "transactions," such references pertain specifically to the user's transfer and receipt activities conducted through TokenPocket. These activities are fundamentally different from "transactions" executed on exchanges or trading platforms.
  5. DApps integrated into TokenPocket include both those owned by the Company and those provided by third-party platforms. For third-party DApps, TokenPocket acts solely as a blockchain browser, enabling users to access these DApps. Before accepting services or conducting transactions on third-party DApps, users must independently assess and evaluate the associated risks.

5. Your Rights and Obligations

    You are entitled to create and/or import a wallet on your mobile device via TokenPocket. You may set wallet passwords and use the TokenPocket application to conduct transfers, receive payments, and perform transactions on the blockchain using your wallet.

  3. Identity Verification:
    In accordance with applicable laws, regulations, and policies, specific users must complete identity verification as prompted by TokenPocket. You may be required to provide personal information, including but not limited to your name, ID number, phone number, and bank account details. Failure to complete the verification process promptly may result in an inability to use related services, with any losses incurred being borne solely by you.

  4. Software Versions:
    The Company may develop different versions of the software for different devices. You should download and install the appropriate version based on your actual needs. If you obtain the software or installation files from an unauthorized third party, the Company cannot guarantee its functionality or safety, and you will bear any resulting losses.

  5. Software Updates:
    After a new version of the software is released, older versions may no longer be usable. The Company does not guarantee the security, continued availability, or customer support for older versions. Please ensure you verify and download the latest version in a timely manner.

  6. Usage

  7. Safeguarding Information:
    You are responsible for securely storing your mobile device, wallet password, private key, mnemonic phrase, and Keystore. The Company does not store this information on your behalf. Any risks, liabilities, losses, or costs arising from lost devices, disclosed passwords, forgotten private keys, mnemonic phrases, Keystores, or incidents of theft or fraud are solely your responsibility.

  8. Following Instructions:
    You agree to follow the instructions and prompts provided by TokenPocket. Failure to do so will make you solely responsible for any resulting risks, liabilities, losses, or costs.

  9. Third-Party DApps:
    You acknowledge that TokenPocket has no obligation to perform due diligence on linked third-party DApps or their transactions. You should make rational investment decisions and assume responsibility for any associated investment risks.

  10. Completing Identity Verification:
    If TokenPocket reasonably believes your transaction behavior or identity information is abnormal, or if additional documentation is deemed necessary, you are required to cooperate and provide valid identification or other necessary documents in a timely manner.

  11. Transfers

  12. Transaction Limits:
    You acknowledge that the daily transfer limits and transaction frequencies within TokenPocket may vary depending on your country/region, regulatory requirements, transfer purpose, TokenPocket’s risk controls, and identity verification.

  13. Irreversible Transactions:
    You understand that blockchain transactions are "irreversible" by nature. When using TokenPocket's transfer function, you are solely responsible for the consequences of operational errors, such as entering an incorrect address or selecting an unsuitable transaction node.

  14. Causes of Transfer Failures:
    You acknowledge that the following circumstances may result in transaction failures or timeout errors:

  15. Insufficient wallet balance.

  16. Insufficient miner fees for the transaction.

  17. Failure to execute smart contract codes on the blockchain.

  18. Exceeding payment limits set by regulators, TokenPocket, or legal authorities.

  19. Technical issues such as network or device failures.

  20. Blockchain network congestion or malfunctions.

  21. Addresses identified as high-risk, such as exchange addresses, ICO addresses, or token-related addresses.

  22. Completion of Service:
    Once you have completed a transfer using TokenPocket, the Company has fulfilled its obligations for that specific service. The Company is not liable for any subsequent disputes or issues.

  23. Compliance:
    When conducting transactions through TokenPocket or its integrated DApps, you are required to comply with applicable laws, regulations, and national policies.

  24. Notifications:
    TokenPocket may send notifications via website announcements, emails, SMS, phone calls, in-app messages, pop-ups, or client notifications. These may include updates on transaction progress or prompts for related actions. Please pay attention to such notifications in a timely manner.

  25. Service Fees and Tax Obligations

  26. Service Fees:
    Currently, TokenPocket does not charge service or handling fees. If charges are introduced in the future, they will be outlined separately or publicly announced.

  27. Miner Fees:
    When conducting transfers via TokenPocket, you must pay miner fees, the amount of which is determined by you. These fees are collected by the respective blockchain system.

  28. Unsuccessful Transactions:
    You acknowledge that in certain cases, due to environmental or network instability, your transaction may not be completed, yet miner fees may still be deducted by the blockchain system.

  29. Tax and Financial Obligations:
    You are solely responsible for all taxes and fees incurred from transactions conducted via TokenPocket.

6. Risk Warnings

  1. Risks in the Digital Token Domain:
    You acknowledge and understand that the legal and regulatory frameworks governing digital tokens are still under development, and this field carries significant risks, including non-redeemability and technological instability. Additionally, the price volatility of digital tokens is much higher than that of other financial assets. We strongly recommend that you assess your financial condition and risk tolerance before deciding to hold or dispose of any digital tokens. The market view function provided by TokenPocket merely fetches token price data from certain exchanges and blockchain sources and should not be interpreted as the latest market price or the best available rate.
  2. Transaction Failures:
    If you or your counterparty fails to comply with this Agreement or fails to follow the instructions, prompts, or rules provided on the website or transaction/payment pages while using TokenPocket services, TokenPocket does not guarantee the successful transfer of tokens and is not responsible for any consequences of such failures. Once payment has been received in a TokenPocket wallet or a third-party wallet, you acknowledge that blockchain transactions are irreversible. You and your counterparty are solely responsible for any risks and consequences arising from your transactions.
  3. Irreversible Transactions:
    You understand that blockchain operations are inherently “irreversible,” and associated transactions are irrevocable. Any risks or consequences must be borne solely by you and your counterparty.
  4. Third-Party DApps:
    When using third-party DApp services or conducting transactions integrated within TokenPocket, we advise you to carefully read this Agreement and TokenPocket’s prompts. Familiarize yourself with the counterparties and product information and cautiously evaluate risks before proceeding. Any transaction you perform on a third-party DApp is your personal action, and any binding contractual relationship is established between you and your counterparty. TokenPocket bears no responsibility for any risks, liabilities, losses, or costs resulting from your transactions.
  5. Counterparty Risk:
    During transactions, you should independently verify whether your counterparty possesses full civil capacity and make your own decision about whether to transact or transfer funds to the counterparty. You assume all risks related to these decisions.
  6. Error Handling in Transfers:
    If you encounter errors such as "transaction failure" or "packaging timeout" during a transfer, you should confirm the transaction status using the official blockchain system or other blockchain query tools to avoid duplicate transfers. Any resulting losses or costs will be your sole responsibility.
  7. Wallet and Credential Storage:
    After creating or importing a wallet in TokenPocket, your Keystore, private key, mnemonic phrase, and related information are stored exclusively on your mobile device and not on TokenPocket or the Company’s servers. You may use TokenPocket’s synchronization guide to migrate your wallet to a different device. However, if you fail to save or back up your wallet credentials (wallet password, private key, mnemonic phrase, Keystore) and subsequently lose your device, your digital tokens will be lost, and the Company cannot retrieve them. Similarly, if these credentials are leaked during export, storage, or backup, or if your storage device or server is hacked or compromised, your digital tokens may be lost, and the Company will not be able to recover them.
  8. Backup Recommendations:
    We recommend securely backing up your wallet credentials (wallet password, private key, mnemonic phrase, Keystore) when creating or importing a wallet. Avoid using the following backup methods: screenshots, emails, notes, SMS, WeChat, QQ, or other electronic methods. Instead, write down your mnemonic phrase and Keystore on a physical notebook, and consider storing electronic backups in a secure password manager.
  9. Secure Network Environment:
    Use TokenPocket only in a secure network environment. Ensure your mobile device has not been jailbroken or rooted to minimize potential security risks.
  10. Fraud Awareness:
    Be vigilant against fraudulent activities that do not originate from TokenPocket’s official channels. If you detect such activities, we encourage you to report them to us promptly.

7. Modification, Interruption, and Termination of Services

  1. Changes to Services:
    You agree that the Company may, in its sole discretion, temporarily provide certain service functionalities, suspend specific functionalities, or introduce new functionalities in the future to maintain its independent business operations. Any addition, reduction, or change to the services will be considered accepted by you as long as you continue to use the services provided by the Company, thereby agreeing to this Agreement and its revised terms.
  2. Service Interruption:
    You understand that the Company may suspend services under the following circumstances:
    1. Technical reasons such as device maintenance, blockchain system repairs, upgrades, failures, or communication disruptions.
    2. Force majeure events, including but not limited to typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, viruses, malware, hacking, system instability, or government actions, that prevent the Company’s systems from providing services or make continued service provision significantly risky in the Company’s reasonable judgment.
    3. Other situations beyond the Company’s control or reasonable anticipation.
    4. If you engage in any of the following, the Company may unilaterally suspend or terminate your access to certain or all functionalities of TokenPocket:
      1. User’s death.
      2. Theft or misuse of another person’s wallet information or mobile device.
      3. Providing false information when completing personal information fields.
      4. Refusing mandatory updates initiated by the Company to improve TokenPocket functionality.
      5. Using TokenPocket for illegal or criminal activities.
      6. Interfering with the normal use of TokenPocket by other users.
      7. Impersonating Company staff or management.
      8. Attacking, infiltrating, altering, or otherwise threatening the normal operation of the Company’s computer systems.
      9. Using TokenPocket to disseminate spam advertisements.
      10. Spreading rumors or defaming the Company or TokenPocket.
      11. Committing any illegal acts, violating this Agreement, or engaging in activities that the Company reasonably believes warrant suspension of functionalities.
  3. Access to Wallet Information:
    If your service relationship with the Company is altered, interrupted, or terminated, you will retain the right to export your wallet information within a reasonable timeframe.

8. Your Commitment to Lawful Use of the Company’s Services

  1. Compliance with Laws and Regulations:
    You must comply with the laws and regulations of the country or region in which you reside. You may not use TokenPocket for any unlawful purposes or in any illegal manner.
  2. Prohibited Activities:
    You are prohibited from using TokenPocket to engage in illegal or criminal activities, including but not limited to:
    1. Engaging in any unlawful or criminal acts, such as money laundering, illegal fundraising, etc.
    2. Using automated programs, software, engines, web crawlers, web analytics tools, data mining tools, or similar tools to access the Company’s services, collect or process the content provided by the Company, or interfere with or attempt to interfere with other users’ access or other means of accessing the Company’s services.
    3. Providing gambling information or inducing others to participate in gambling in any manner.
    4. Gaining unauthorized access to another person’s TokenPocket wallet to steal digital tokens.
    5. Conducting transactions that deviate from the declared terms of the counterparty or that are fraudulent.
    6. Performing actions that damage or may potentially damage TokenPocket’s service systems or data.
    7. Engaging in any other illegal actions or behaviors that the Company has reasonable grounds to deem inappropriate.
  3. Indemnification:
    You acknowledge and agree that if your violation of applicable laws (including but not limited to customs or tax regulations) or this Agreement results in the Company suffering any loss, being subject to claims from third parties, or facing penalties from administrative authorities, you will compensate the Company, including reasonable attorney fees.
  4. Eligibility:
    You confirm that you are not a person excluded from eligibility to use TokenPocket services.
  5. Service Fees:
    You agree to pay any service fees (if applicable) promptly. Failure to do so grants the Company the right to suspend or terminate the services provided to you.

9. Privacy Policy

The Company places great emphasis on protecting user privacy. For details, please refer to the TokenPocket Privacy Policy, which is published and updated periodically by the Company.

10. Disclaimers and Limitation of Liability

  1. Scope of Responsibility:
    The Company is only responsible for fulfilling the obligations explicitly outlined in this Agreement.
  2. Service Availability:
    You acknowledge and agree that, to the extent permitted by law, the Company provides TokenPocket services based on existing technological capabilities and conditions. The Company assumes no liability for service disruptions caused by the following:
    1. System maintenance or upgrades for TokenPocket.
    2. Force majeure events, including but not limited to typhoons, earthquakes, floods, lightning strikes, terrorist attacks, or similar events.
    3. Failures in your mobile device's hardware, software, communication lines, or power supply.
    4. Improper operations by you or usage of the Company's services through unauthorized or unapproved methods.
    5. Attacks by viruses, malware, or malicious programs; network congestion; system instability; system or equipment failures; communication disruptions; power outages; banking issues; or governmental actions.
    6. Any other causes not attributable to the Company.
  3. Exclusions of Liability:
    The Company assumes no responsibility for the following circumstances:
    1. Loss of digital tokens resulting from users losing their mobile devices, deleting TokenPocket without a backup, deleting wallets without a backup, wallets being stolen, or forgetting wallet passwords, private keys, mnemonic phrases, or Keystores.
    2. Loss of digital tokens resulting from users disclosing their wallet passwords, private keys, mnemonic phrases, or Keystores; lending, transferring, or authorizing others to use their mobile devices or TokenPocket wallets; or downloading the TokenPocket application from non-official sources or using unsafe methods to operate the application.
    3. Loss of digital tokens due to user operational errors, including but not limited to entering incorrect transfer addresses or selecting unsuitable transaction node servers.
    4. Loss of digital tokens resulting from user errors or misunderstandings of blockchain technology.
    5. Deviations in transaction records caused by delays, instability, or other issues with the blockchain system that TokenPocket uses to replicate blockchain transaction data.
  4. User Accountability for Personal Causes and Force Majeure:
    Losses resulting from personal reasons (e.g., lost phone numbers, email addresses, leaked verification codes, publicly disclosed private keys, or compromised personal information) or force majeure events are not the responsibility of the Company.
  5. Risks Associated with Third-Party DApps:
    You understand that TokenPocket functions solely as a tool for managing digital tokens. The Company has no control over the quality, safety, legality, or accuracy of the products or services provided by third-party DApps, nor over the counterparties’ ability to fulfill their contractual obligations.
    1. Transactions conducted on third-party DApps are entirely your responsibility, and any contractual relationship established is strictly between you and the counterparty.
    2. The Company urges you to exercise discretion and diligence in verifying the authenticity, legality, and validity of the DApp and related information.
    3. Risks arising from interactions with third-party exchanges are your responsibility.
    4. The Company may provide services to both you and your counterparty. By using TokenPocket, you expressly waive any actual or potential claims of conflicts of interest against the Company and agree not to attribute any legal defects to the Company's services or increase its liability or duty of care.

11. The Company Does Not Provide the Following Guarantees:

  1. The services provided by the Company will fully meet your requirements.
  2. Any technology, products, services, or information obtained through the Company’s services will meet your expectations.
  3. The timeliness, accuracy, completeness, or reliability of digital token market data or trading information retrieved from third-party exchanges.
  4. That the parties involved in your transactions via TokenPocket will fulfill their obligations under the agreements made with you.
  5. In any case, the total liability of the Company for breach of this Agreement shall not exceed the higher of A. 0.1 Ether or B. 100 USD.
  6. TokenPocket is solely a tool for managing digital tokens and displaying transaction information. The Company does not provide legal, tax, or investment advice. You should seek guidance from legal, tax, or investment professionals independently. The Company assumes no responsibility for any investment losses or data losses incurred during your use of the services.
  7. The Company reserves the right to modify its user eligibility criteria in compliance with applicable policies and regulations, restricting service scope and access to specific groups as necessary.

12. Entire Agreement

  1. This Agreement consists of the TokenPocket Service Agreement, the TokenPocket Privacy Policy, and other rules published and updated by the Company from time to time.
  2. If any part of this Agreement is deemed invalid or unenforceable by a court with jurisdiction, the remaining provisions shall remain in full force and effect.
  3. Any translated version of this Agreement is provided solely for the convenience of users. In the event of a conflict between the Chinese version and a non-Chinese version, the Chinese version shall prevail.

13. Intellectual Property Protection

TokenPocket is an application developed and owned by the Company, which holds all associated intellectual property rights. The intellectual property rights of all content displayed within TokenPocket (including this Agreement, announcements, articles, videos, audio files, images, documents, information, materials, trademarks, or logos) are owned by the Company or third-party rights holders.

Users are only permitted to use the TokenPocket application and its content for the purpose of holding and managing digital tokens. Without prior written consent from the Company or relevant third-party rights holders, no person may use, modify, reverse engineer, copy, publicly disseminate, alter, distribute, publish, or publicly share the application or its content.

14. Governing Law and Dispute Resolution

  1. This Agreement and its amendments shall be governed by and construed in accordance with the laws of the Cayman Islands. Where relevant laws are absent, international business practices and/or industry norms shall apply.
  2. Any disputes or disagreements between you and the Company shall first be resolved through friendly negotiation. If negotiations fail, either party may submit the dispute to a court with jurisdiction in the Company’s place of registration.

15. Miscellaneous

  1. If you are a user outside the Cayman Islands, you are responsible for fully understanding and complying with all laws, regulations, and rules applicable to your jurisdiction while using the Company’s services.
  2. If you encounter any issues while using the Company’s services, you can contact us via the feedback feature in TokenPocket.
  3. You may access this Agreement within TokenPocket. The Company encourages you to review the Service Agreement each time you use TokenPocket. This Agreement is effective as of November 11, 2024.
